The ANC government recognized the need to create a base for strategic governance.
(47*) This led to taking up an interim Constitution (1993) that outlined the
framework upon which the final Constitution would be based. In 1996, after two
years of public consultation and debate, South Africa adopted its new
Constitution, which came into effect on 4 February 1997.
Government was applauded for the process followed to establish the
Constitution as well as for its “quality”. Even now countries across the world
still refer to South Africa ’s
constitution as a “model”. (48*) The Media Club of South Africa confirms this
and reports that the Constitution is admired and respected around
the world for its pioneering approach to human rights.
The Constitution includes the Bill of Rights. This was followed by a
wide range of supporting structures, as well as legislative and other
directives forming a base for sound governance.
The study is consistent in highlighting incompatibilities between
the Constitution and the NDR.
